Maricopa County Attorney decides not to prosecute Brady Kiser in son’s Chandler drowning

PHOENIX — Brady Kiser will not be charged in the drowning death of his 3-year-old son Trigg Kiser, the Maricopa County Attorney’s Office announced Friday.

The Chandler Police Department submitted the case to MCAO for review earlier this month and recommended that Kiser be charged with one count of child abuse.

In the announcement, MCAO stated that Kiser was not being charged due to there being no reasonable likelihood of conviction.

Why is the county attorney not prosecuting Brady Kiser for son’s drowning?

MCAO explained that in order to convict someone of the recommended charge, the state has to prove beyond a reasonable doubt to the jury that the person failed to perceive a substantial and unjustifiable risk as well as that the failure to perceive risk was a “gross deviation” from the standard of care a person would show.

The attorney’s office said that after careful review of the evidence submitted by Chandler PD, it determined that the case did not meet that standard.

Experienced senior attorneys and Maricopa County Attorney Rachel Mitchell were part of the case’s review.

Details on Trigg Kiser’s Chandler drowning

The 3-year-old died on May 18 at the hospital, a week after Kiser found him in the pool at the family’s house in Chandler. His death was the first child drowning reported in 2025 in the Valley.

According to NBC News, TikTok influencer Emilie Kiser — wife of Brady and mother of Trigg — filed a lawsuit in May to keep public records about her son’s death from being released, citing “a media frenzy.”

Emilie Kiser has 4 million followers on TikTok.

However, in June, The Arizona Republic obtained search warrant applications about the drowning and reported details.

It revealed that Emilie was out with friends at the time of the drowning and that Brady was watching Trigg and the couple’s infant, born earlier this year.

Brady Kiser reportedly said that he was distracted by the baby and lost sight of Trigg for several minutes before finding him in the pool.
