Felon who shot at police in Phoenix sentenced to 20 years in prison

PHOENIX — A felon who opened fire on officers with the Phoenix Police Department two years ago was recently sentenced to 20 years in prison.

Officers found Eberto Hernandez with a handgun after responding to his residence due to reports of shots being fired, according to the Maricopa County Attorney’s Office (MCAO).

Hernandez fired multiple rounds into the couch he was sitting on when his mother answered the door for officers, MCAO said.

He continued firing shots, including some aimed at his mother, who tried to disarm him. He also opened fire at the officers, who stayed outside the home.

By the time his mother got the gun away from him, Hernandez had fired more than 20 rounds inside the residence, MCAO said.

Hernandez later surrendered.

“Mr. Hernandez turned a neighborhood call for help into a life-threatening situation for his own family and our police officers,” Maricopa County Attorney Rachel Mitchell said in a Friday announcement.

What charges did felon found guilty of shooting at police face?

A jury convicted Hernandez  on these charges:

• Two counts of aggravated assault on a police officer.
• One count of aggravated assault.
• One count of unlawfully discharging a firearm.
• Three counts of disorderly conduct.

In addition to his 20-year sentence, he was also handed an additional 2.5 years in prison for violating his probation. It will be added to his sentence.

“This sentence sends a clear message: when you endanger others with a firearm, especially as a prohibited possessor, you will be held fully accountable,” Mitchell said.
