SUV driver charged with 2nd-degree murder for crash that killed motorcyclist in Chandler

PHOENIX — A man has been formally accused of intentionally crashing his SUV into a motorcyclist, leading to the rider’s death, authorities announced Monday.

Gustavo Gavia Elias, 29, was indicted in connection with a March 18 road rage incident near Ray and Alma School roads, according to the Maricopa County Attorney’s Office.

He is facing one count of second-degree murder, two counts of child abuse and two counts of aggravated driving while under the influence.

Prosecutors said Elias intentionally struck a motorcycle while driving under the influence with two juvenile passengers in the vehicle.

According to court documents, the two children said Elias and the motorcycle driver were aggressive toward each other. They reported that the motorcyclist pulled up to the front passenger side and struck the vehicle with his hand, possibly breaking the rearview mirror.

Elias later told a sergeant that he and the motorcycle driver lived in the same apartment complex and that the rider often revved his engine loudly and sped through the parking lot, according to court documents.

Elias also allegedly told police he had consumed about 12 Corona beers and used cocaine before driving the children to a friend’s house for a sleepover.

The victim, whose name was not released, died of internal decapitation.

The Arizona Department of Child Safety was notified.
