PHOENIX — Two more Arizona inmates were accused of voting in the 2020 election despite being convicted felons who didn’t have their voting rights restored, bringing the total filed by the attorney general’s office to five.

Michael Damian Herrera, 25, and Shadae Alexis Smith, 29, were each indicted on one count of false registration and one count of illegal voting for allegedly registering and casting a vote in the 2020 general election while they were inmates at the Pima County Jail.

Herrera allegedly completed a voter registration form indicating he had not been convicted of a felony or that his right had been restored, according to the AG’s office.

The Tucson man had previously been convicted and didn’t have his rights restored since his most recent conviction in 2018.

Smith, also from Tucson, allegedly filled out the same form with the same options as Herrera.

She had previously been convicted of two felony offenses and hadn’t had her rights restored since her most recent conviction in 2010.

Herrera and Smith were being held at Pima County Jail.

Smith’s pre-trial conference is Dec. 1. Herrera’s is Feb. 22.

Victor Manuel Aguirre, 46, of Sahuarita, was indicted in late October on similar charges.

Two other men have also been charged with voting despite being convicted felons who hadn’t had their rights restored.
