A transgender man may not be granted a divorce in Arizona, because the state does not recognize gay marriages.

According to the New York Daily News, Thomas Beatie and his wife, Nancy, were married in Hawaii, a state that recognizes gay marriage.

Beatie was born as a woman in Hawaii and had a sex change before getting married. He still retains some female organs.

Beatie, who lives in Phoenix, gave birth to three of the couple’s children because his wife is infertile.

Hawaii recognizes Beatie as a man. Arizona does not because of the female organs.

“Hawaii said okay, that it’s a valid marriage,” said his attorney, David Michael Cantor. “Who is Arizona to say, well, we’re going to ignore one of the other 49 states and say this not a valid marriage?”

Cantor said the subject is new territory for Arizona.
