Bicyclist killed in crash involving driver suspected of impairment in Phoenix

A bicyclist was killed in a collision involving a driver suspected of impairment in Phoenix on Tuesday night, authorities said.

PHOENIX – A bicyclist was killed in a crash involving a driver suspected of impairment in Phoenix on Tuesday night, authorities said.

Officers responded to a collision call in the area of 19th Avenue and Van Buren Street around 9 a.m., according to the Phoenix Police Department.

They found a bike rider, 57-year-old Dave Smith, suffering from serious injuries. He was pronounced dead after being rushed to a hospital.

Smith was crossing Van Buren Street midblock when he was hit by an eastbound vehicle, police said.

Was driver who struck bicyclist arrested?

Although the man driving the vehicle showed signs of impairment, he was processed and released from the scene. However, he could still face charges related to the fatal collision.

“Charging decisions will be made after the accident reconstruction process is complete and the full impairment results are obtained,” Sgt. Rob Scherer said in a media advisory.

Another bang up job protecting a POS' "rights".
ARREST them. If they're found to be not impaired, then apologize and THEN make an accurate charging decision.
THEY JUST KILLED SOMEONE.
