PHOENIX — The Arizona Administrative Office of the Courts website has released a website that gives guidance and eligibility on the expungement process for marijuana records.
The website provides information on Prop 207 and provisions that will help individuals determine if they qualify for clearing pot offenses.
The voter-led initiative legalized recreational marijuana in the state and was passed in the November 2020 election.
Provisions and the application process for expunging records that show the arrest, charge, adjudication, conviction or sentence of certain marijuana-related offenses will go into effect July 12.
Adults and juveniles are eligible for expungement if the applicant meets the requirements outlined in Arizona state law and the Arizona rules of criminal procedure.
There is no charge for filing an expungement petition.
If a record is expunged, it will be sealed from the public but still be available to the applicant.
Some applicants may need to file a petition in a municipal, justice or superior court depending on the case.
