Gay man ordered in will to marry surrogate mother

The son of a gay man may not receive his inheritance unless his father marries the surrogate mother who gave birth to him.
According to the New York Post, Frank Mandelbaum, who died in 2007, does not want his grandson, Cooper, to receive his $60,000 trust inheritance unless Mandelbaum’s gay son, Robert, marries the surrogate mother who gave birth to Cooper.
Frank Mandelbaum specified in his will that his son must marry the surrogate mother of Cooper within six months of the boy’s birth or the child would lose his share of the trust.
Some argue that Frank Mandelbaum can do what he wants with his money, but others argue the will’s requirements are in violation of both New York state law and moral codes.
Robert Mandelbaum married his partner, Jonathon O’Donnell, shortly after Cooper’s birth. He said O’Donnell is the only “mother” that Cooper knows.
