Judge dismisses man’s lawsuit against CDC

ATLANTA (AP) – A federal judge has dismissed a lawsuit filed against the Centers for Disease Control and Prevention by an Atlanta lawyer whose misdiagnosed tuberculosis case caused an international health scare.
The Atlanta Journal-Constitution reports (
http://bit.ly/xLSvNs) that the case was dismissed Wednesday by U.S. District Judge William Duffey.
Andrew Speaker claimed in the lawsuit that the CDC revealed his private medical condition at press conferences beginning in May 2007 to dramatize the possibility that diseases like TB can be transmitted worldwide. Government attorneys countered that there was no proof the CDC leaked his name to the press.
The judge, in a 60-page order, found that the record in the case did not support a finding that the CDC intentionally or willfully disseminated inaccurate, irrelevant or unnecessary information about Speaker.
