PHOENIX – An armed robbery suspect shot by Phoenix police near the Arizona Capitol earlier this month was arrested Tuesday after getting released from the hospital, authorities said.

Gary Sherrod, 32, was booked into Maricopa County Jail on one count of aggravated assault.

Sherrod was shot the night of Jan. 6 by an officer responding to a call about a man with a gun threatening to rob a convenience store near 17th Avenue and Van Buren Street, according to the Phoenix Police Department.

Officers arrived to find Sherrod outside the store. Police said he pulled out a gun and began pointing it in different directions.

Sherrod allegedly refused commands to drop the weapon and continued waving it around, prompting one officer to shoot him.

Officers performed first aid until the Phoenix Fire Department arrived and took Sherrod to a hospital.

Police didn’t release details about the nature of his injury.
