PHOENIX – A Phoenix elementary school teacher was recently arrested after an adult woman accused him of having sex with her when she was 16 years old and he was around 30, according to court documents.

The victim, now 22, told police 36-year-old David Arlo Beck had sexual intercourse with her on multiple occasions from 2013 until the past year.

According to the probable cause statement, Beck admitted on a recorded phone call with the victim that she was 16 when they started having sex and told her to lie and say she was 20 when it started.

He was arrested Nov. 22 on two counts of sexual conduct with a minor, a Class 6 felony.

Under state law, sexual conduct with a minor under 18 and at least 15 is a Class 6 felony, but it would be a Class 2 felony if the defendant “is or was in a position of trust.”

The presumptive penalties for first-time offenders in Arizona are one year in prison for a Class 6 felony and five years for Class 2.

No details about how Beck and the victim knew each other were made public.

Beck said he’d been employed by Fowler Elementary School District in west Phoenix for three years.

The district released the following statement Tuesday:

Fowler Elementary School District received communication from a Phoenix police detective on November 21, 2019, that David Beck was under investigation by that police department. The District placed him on administrative leave on that date. He has not returned to our campuses. The District administration has continued to co-operate with the authorities regarding this matter. The District does not have any information that any district student was involved in the allegations that have led to his arrest.

During his preliminary hearing Tuesday, Beck said he has a mother with cancer and five kids at home. The judge set bail at the $50,000 amount requested by the prosecutor.

The state opposed Beck’s unsecured release because he had access to children in his job as a teacher.
