Arizona AG Mark Brnovich files lawsuit against Biden’s student debt forgiveness

Sep 29, 2022, 2:43 PM | Updated: 2:48 pm

PHOENIX – Arizona Attorney General Mark Brnovich followed other states and groups in filing a lawsuit against President Joe Biden’s student debt forgiveness plan.

Brnovich announced Thursday that he filed a complaint against the Biden administration in U.S. District Court for the District of Arizona.

“This mass debt forgiveness program is fundamentally unfair, unconstitutional, and unwise,” Brnovich, a Republican, said in a press release. “The question Americans need to be asking is why college costs so much in the first place.”

Biden, a Democrat, wants to forgive $10,000 in student loan debt for those making less than $125,000 or households with less than $250,000 in income. Pell Grant recipients, who typically demonstrate more financial need, would get an additional $10,000 in debt forgiven.

Brnovich argued that Biden doesn’t have the authority to take such an action.

Earlier Thursday, six other Republican-led states announced they are suing Biden over the plan he revealed last month. Iowa, Kansas, Missouri, Nebraska and South Carolina joined Arkansas in the suit filed in a federal court in Missouri.

That came two days after a California Libertarian group filed what was believed to be the first legal challenge to Biden’s debt relief plan. It was filed in federal court in Indiana, one of several states that plan to tax any student debt canceled by Biden’s plan.
