Arizona court upholds ruling on fish pedicures

PHOENIX — A new court ruling upheld a judge’s rejection of an Arizona
salon owner’s lawsuit that challenged cosmetology regulators’ decision to stop
her from offering pedicures using fish.

The state Court of Appeals ruled Tuesday that the state Board of Cosmetology
didn’t violate Cindy Vong’s constitutional rights when it said Vong couldn’t
provide fish pedicures. The fish nibble dead skin off customers’ feet.

The regulators said the fish were an unsafe tool for skin exfoliation that
couldn’t be sanitized in between uses.

Vong had opened a fish spa within her nail salon in Gilbert but was later
forced to close that part of her business.

Vong argued the board violated her due-process and equal-protection rights, but
the Court of Appeals ruled that the board had rational grounds for its decision.
