Attorney: Ariz. medical marijuana patients being arrested

A Valley attorney is outraged that medical marijuana patients Valley-wide are allegedly being arrested for drug possession.

According to ABC15, the Rose Law Group said they have had calls from dozens of medical marijuana patients who have had run-ins with police.

"We've heard of one case where the SWAT team went and raided a gentleman's home," said [attorney Adam] Trenk. "This is an outrage."

Arizona voters may have approved medical marijuana, but the Arizona Department of Health has put a halt to many card holders' demands for the drug, pending federal approval of the law.

Whether or not the law is federally approved, the police must accept that the law was approved in Arizona, Trenk said.

"If the person is a qualified patient and they have the ID card, they need to be left alone by police," said Trenk. "If they're arrested, they need to contact an attorney."

Phoenix police said they were unable to comment on the arrests without specifics, which Trenk was unable to give.

    medical marijuana users- NOTE: I did NOT say "Dope smokers" or "partiers" because it ISN'T the same thing. I use marijuana to dull my severe chronic pain enough so I can Actually Sleep at night. Voters have said I have the right to use this a a medication- and it works MUCH better than the MANY painkillers I have been on. That the Federal and State politicos are trying to block it is really a severe injustice and I can see MANY lawsuits in the making from this! Let us have a little relief.

    Medical marijuana is now legal pursuant to state law so long as the patient complies with the requirements and obtains the required card. Those people who don’t like the change in the law because they desire to control what other adults put in their bodies will have to get over their desire to run the lives of others.     If law enforcement would have just enforced Federal immegration law like they want to enforce the Federal Pot laws there wouldn't had been any need for SB1070. What happened to the sovriegn rights of the States? So are we to assume that if the State law is less restrictive the federal law will still govern? Sounds like it but they should have made that clear when AZ's med pot law was voted in.
