University spokeswoman Jacque Montgomery says 24-year-old Holmes, who police say is the suspect in a mass shooting at a Colorado movie theater, was studying neuroscience in a Ph.D. program at the University of Colorado-Denver graduate school. Holmes is suspected of shooting into a crowd at a movie theater killing at least 12 people and injuring dozens more, authorities said. (AP Photo/University of Colorado)

CENTENNIAL, Colo. (AP) - Prosecutors in the Colorado theater shootings say laws on insanity and the death penalty are constitutional and don't need any of the explanations requested by the defense.

Attorneys for the state filed their response Wednesday to motions by James Holmes' lawyers saying the laws are vague. The defense also argues the laws violate Holmes' rights by possibly barring him from calling witnesses to testify about his mental health during the trial's penalty phase.

Holmes is charged with killing 12 at a movie theater in July. Prosecutors are seeking the death penalty.

A judge entered a standard not guilty plea on Holmes' behalf. He wants to change that to not guilty by reason of insanity.

The judge must approve the change after ruling on defense objections to the laws.

Before making statements about the CC crowd, you should really learn something about the CC crowd and not what anti-gun groups think about them. Lets see, the delusions of grandeur, yeah, tell the 71 year old in Florida from Tuesday that. That was no delusion of grandeur in that internet cafe that day.

You (along with so many others) can paint yourself as a freedom fighting defender of the constitution all you like. If you feel the need to go to a movie theater/restaurant/grocery etc. store with a gun on your hip I thinks its pretty safe to you are a bit fanatical when it comes to firearms. If you think the general public is appreciative and some how feels safer when you walk into an establishment armed you are completely delusional.

Can we wait until we have ALL the facts before we assign blame to anybody? After the Giffords shooting, everyone tied Loughner to every fringe group under the sun and it turned out he was just a nut job, As a logical thinking person, I'm offended that you would start assigning blame without any idea of what's really going on. As someone who is originally from Boulder, I think you should actually visit the city before you start making assumptions about it.

I could give crap what the general public thinks about armed citizens. I care about defending myself and others if need be. You sound like a typical sissy who hates guns. I learned how to shot when I was in the military, defending pansies like you. Even with body armor on, a .45 at close range, is still going to do damage. His gas mask couldn't have stopped a round to the face...
