PHOENIX -- Maricopa County Attorney Bill Montgomery is asking an Arizona appeals court to temporarily put on hold a trial judge's ruling that the county must provide zoning clearance for a planned medical marijuana dispensary in Sun City.

A three-judge Court of Appeals panel scheduled a hearing next Thursday on Montgomery's request Friday for a stay of Superior Court Judge Michael Gordon's ruling.

Montgomery is appealing Gordon's ruling that federal drug laws don't stand in the way of implementation of Arizona's voter-approved medical marijuana law.

Montgomery says county employees stand at risk of possible federal prosecution if they facilitate marijuana growing, distribution or marketing of marijuana.

Gordon already refused to put his own ruling on hold pending the appeal.

    This guy is like a little kid who doesn't like the answer that he gets from mom and so he goes off in search of dad for a different answer. County attorneys enforce state law, not federal law. If Billy really wants to enforce federal law maybe he should go to work for the justice department. People like Billy really don't care what the state law says because its obvious that county attorneys know more than voters. I hope that the voters in Arizona are watching very carefully what this guy really thinks about Arizona law and vote accordingly the next time Billy is up for reelection.
