Attorneys seek 5-year sentence for ex-border agent

PHOENIX — Prosecutors and a defense attorney are requesting a five-year
prison sentence for a former Border Patrol agent who admitted smuggling
marijuana while on duty along the Arizona-Mexico border.

Lawyers on both sides made the recommendation in former agent Aaron Anaya’s
case after a judge postponed his sentencing and asked the attorneys to say
whether Anaya had been involved in similar crimes.

The lawyers told the judge that while authorities had information of potential
illegal conduct that led to surveillance of Anaya, prosecutors don’t have enough
evidence of prior crimes that could meet the required legal burdens.

Anaya faces five years up to life in prison for his guilty plea to possessing a
firearm in furtherance of a drug-trafficking offense.

His sentencing is set for Sept. 16.
