Appeals court upholds ruling on Arizona’s bail law

PHOENIX — An appeals court has upheld a lower court’s ruling that
dismissed a challenge to an Arizona law that denies bail to people who aren’t in
the country legally and are charged with murder, sexual assault and other
serious felonies.

The ruling on Tuesday by a three-judge panel of the 9th U.S. Circuit Court of
Appeals concluded that the immigrant rights advocates who challenged the law
didn’t raise issues of fact on whether Proposition 100 violates constitutional
due-process guarantees.

The court also rejected the argument by the immigrant rights advocates that the
state law conflicts with federal law.

Arizona voters approved the bail denial proposal in 2006.

The lawyers pushing the challenge say they plan to ask a larger panel of the
appeals court to consider its appeal.
