Arizona tree-sitter contests proposed restitution

FLAGSTAFF, Ariz. — A man convicted of littering and trespassing while
perched in a tree at Flagstaff’s Lowell Observatory may also face restitution.

James Kennedy was attempting to stop construction last August on a pipeline
headed to the Arizona Snowbowl by raising a wooden platform about 70 feet in a
tree and tying it to construction equipment below.

The Arizona Daily Sun says the Flagstaff Fire
Department has proposed charging Kennedy nearly $612 in restitution for the cost
of getting him out of the tree.

Kennedy left the tree during a lightning storm, just ahead of firefighters’
moves to evacuate him.

He has challenged the restitution amount sought.

Kennedy says he’s unemployed “and completely broke” and has requested
community service as a sentence instead.

Another court hearing is set for June 20.
