Arizona court asked to put marijuana ruling on hold

PHOENIX — Maricopa County Attorney Bill Montgomery is asking an Arizona
appeals court to temporarily put on hold a trial judge’s ruling that the county
must provide zoning clearance for a planned medical marijuana dispensary in Sun
City.

A three-judge Court of Appeals panel scheduled a hearing next Thursday on
Montgomery’s request Friday for a stay of Superior Court Judge Michael Gordon’s
ruling.

Montgomery is appealing Gordon’s ruling that federal drug laws don’t stand in
the way of implementation of Arizona’s voter-approved medical marijuana law.

Montgomery says county employees stand at risk of possible federal prosecution
if they facilitate marijuana growing, distribution or marketing of marijuana.

Gordon already refused to put his own ruling on hold pending the appeal.
